Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service you are entitled to cancel and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure you are entitled to have the service rectified in a reasonable time. Nothing in these Terms limits those rights.
The scope of work is set out in the written quote provided by Stag Timber Floors. Any work not expressly included in that quote is not part of the agreement. Quotes are valid for 30 days from the date of issue unless otherwise stated.
Unless specifically quoted, the following are not included: removal or replacement of damaged boards; gap filling beyond minor surface filling; subfloor levelling, repair, or replacement; removal of adhesives, tiles, carpet, underlay, or staples; treatment of borer, rot, or water damage; moving of furniture, appliances, or fixtures; disposal of existing floor coverings. Timber is a natural product: variations in colour, grain, reaction to stain or finish, and seasonal movement (expansion/contraction, gapping, cupping) are inherent and not defects.
A deposit of 10% of the total quoted price is payable on acceptance of the quote to secure the booking. This complies with the Home Building Act 1989 (NSW) s8 cap on residential building work deposits.
Progress payments may be required for larger jobs as set out in the quote. Final payment is due on completion of work, prior to final walkthrough sign-off. Payment methods: bank transfer (preferred) or cash. Invoices are issued on completion. Accounts outstanding beyond 7 days from invoice date may attract interest at the Reserve Bank of Australia cash rate plus 2% per annum.
Any change to the scope of work must be agreed in writing (email is sufficient) and may affect the price and timeline. Verbal variations are not binding unless subsequently confirmed in writing by Stag Timber Floors. Discovery of concealed conditions (rot, asbestos, structural defects) may require a variation to address safely.
Workmanship is warranted for 2 years from the date of completion for residential work. Manufacturer warranties on coatings (e.g. Bona) pass through to the customer and are subject to the manufacturer's care instructions. The warranty does not cover: damage from water, pets, furniture without protection, abrasive or unsuitable cleaning products, moisture from subfloor sources, UV fading, or timber movement from humidity changes. Statutory warranties under the Home Building Act 1989 (NSW) apply where relevant.
Customers may cancel at any time before work commences. If cancellation occurs after the deposit is paid but before any materials are ordered or work is booked with third parties, the full deposit is refundable less any reasonable administrative costs incurred. If materials have been specifically ordered or a booking slot has been held and cannot be rebooked at short notice, the deposit or a portion of it may be retained to cover documented costs. Once work has commenced, the customer remains liable for work completed and materials consumed to the date of cancellation. For unsolicited sales agreements (i.e. quotes given in the customer's home without prior request), a cooling-off period of 10 business days applies under the Australian Consumer Law.
The customer must provide safe access to the work area, including power, water, and adequate lighting. Rooms must be cleared of furniture, rugs, and personal items unless otherwise agreed. Pets and children must be kept away from the work area during sanding and finishing for safety reasons. Finish coatings emit vapours during cure; the customer is responsible for ventilation arrangements and for vacating the area for manufacturer-recommended cure times.
Subject to the ACL and other non-excludable statutory rights, Stag Timber Floors' liability for any loss, damage, or defect is limited to rectification of the work or refund of the fee paid for the affected portion of work. We do not accept liability for: pre-existing damage; movement, cracking, or damage to neighbouring finishes, skirting, cornices, or fixtures that is incidental to proper sanding technique; loss of use or consequential loss; damage arising from the customer's failure to follow care instructions.
Any dispute should first be raised in writing to [email protected]. We will acknowledge within 5 business days and attempt to resolve the matter within 21 days. If unresolved, either party may refer the dispute to NSW Fair Trading (fairtrading.nsw.gov.au) or, for residential building disputes exceeding jurisdictional thresholds, to the NSW Civil and Administrative Tribunal (NCAT).
Stag Timber Floors collects personal information (name, contact details, address) for the purpose of quoting, delivering services, and invoicing. We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). We do not sell or share personal information with third parties except as required for service delivery (e.g. couriers, payment processors) or by law. These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of that State.
